This agreement ("Agreement") is between Kunka AI OÜ ("Kunka," "We," or "Us") and the affiliate partner ("Partner" or "You"). Kunka AI is the product promoted under this Agreement. By joining the affiliate program, you accept these terms and conditions.
To begin enrollment, you must register via Thrivecart. We may decline your application if, at our sole discretion, we determine that your platform is not a good fit for the program.

The following actions are prohibited and may result in immediate account termination and forfeiture of commissions:
Commission Rates: Affiliates earn commissions on valid sales attributed to their unique links or promo codes using last-touch attribution. Commissions apply only to Kunka AI product sales. Upsells, cross-sells, and B2B transactions are excluded. Current rates are available on the Kunka AI Affiliate Program page in Thrivecart.
Payout Schedule: Commissions are calculated and paid 30 days after the sale to account for potential refunds or chargebacks.
Minimum Payout: A minimum balance of $75 is required for payout. Amounts below this threshold roll over to the next month.
Payment Method: Payments are issued via wire transfer for accurate record-keeping.
Content you create to promote Kunka AI may be used by us for marketing and promotional purposes. Kunka AI reserves the right to use your name, image, and videos in advertisements, sales pages, or other materials. Any in-person content or recordings you participate in for Kunka may also be used at our discretion.
You agree that confidential information about unreleased features, private plans, or internal strategies of Kunka AI will not be shared publicly or with third parties. This includes future developments, product changes, and marketing initiatives.
Kunka AI and its affiliates are independent contractors. This Agreement does not create a partnership, joint venture, agency, franchise, sales representative, or employment relationship. You may not bind or obligate Kunka AI in any manner.
Kunka AI is not liable for indirect, special, or consequential damages arising in connection with this Agreement or the Affiliate Program. Our total liability will not exceed the referral fees paid or payable to you under this Agreement.
Kunka AI provides no express or implied warranties regarding the Affiliate Program or products sold through it. We do not guarantee uninterrupted or error-free operation of our website and accept no responsibility for interruptions or errors.
This Agreement begins upon our approval of your application and continues until terminated by either party. You or Kunka AI may terminate the Agreement at any time, with or without cause, by providing written notice.
This Agreement constitutes the entire understanding between the parties and supersedes all prior discussions, agreements, or understandings, whether written or oral. Any additional commitments must be in writing and signed by both parties.
We may modify any terms of this Agreement at our discretion, including payment procedures and program rules. We will notify you of changes in writing.
Kunka AI OÜ retains sole discretion over all matters related to this Agreement, including commission payments, tracking, and termination decisions.
Any disputes arising under this Agreement will be resolved through binding arbitration under the rules of the Estonian Chamber of Commerce and Industry (or a comparable EU body). Arbitration will occur in Tallinn, Estonia, in English, before a single arbitrator applying Estonian substantive law. Judgment on the award may be entered in any court of competent jurisdiction. This Agreement is governed by the laws of the Republic of Estonia, without regard to conflict of law provisions, and complies with EU standards, including GDPR where applicable.
