KunkaAI Terms and Conditions

These Terms govern access to and use of KunkaAI's websites, apps, and services (the "Service"). By using the Service, you accept these Terms.

1. Eligibility and Accounts

  • You must be at least 18 and have authority to bind your organization (if applicable).
  • You are responsible for your account credentials and all activity under your account.
  • Keep your information accurate and up to date.

2. Service Description

KunkaAI provides a canvas-first AI workspace that connects to third-party data sources (for example, Google Drive/Docs, YouTube, TikTok Display, Instagram/Meta) to ingest, process, and generate content. KunkaAI may change, suspend, or discontinue features at any time with or without notice.

3. Subscriptions, Billing, Auto-Renewal, Taxes

  • Paid plans are subscriptions that auto-renew until canceled.
  • You authorize KunkaAI and its payment processor (for example, Stripe) to charge subscription fees and applicable taxes at each renewal unless you cancel before renewal.
  • Prices exclude taxes unless stated. Where required, VAT is added at checkout. For Estonian supplies, the standard VAT rate is 24% from 1 July 2025.
  • You are responsible for all applicable taxes, duties, charges, and withholdings.

4. Trials and Promotions

Any free trial or promotion is subject to the terms shown at signup. We may modify or withdraw trials or promotions at any time.

5. Refunds and Cancellations

Refund eligibility, timing, and process are governed by the Refund Policy. This policy is incorporated by reference.

6. Acceptable Use

You will not:

  • Violate law or third-party rights (privacy, IP, contract, platform terms).
  • Upload malicious code or attempt to disrupt or circumvent security.
  • Use the Service for high-risk activities where failure could lead to death, injury, or severe harm (for example, medical diagnosis/treatment, critical infrastructure, aviation, nuclear).
  • Abuse rate limits, scrape without permission, or resell access except as explicitly agreed in writing.

We may suspend or terminate access for violations.

7. Your Content; License to KunkaAI

You retain ownership of content you submit ("User Content"). You grant KunkaAI a worldwide, non-exclusive, royalty-free license to host, process, display, and create necessary technical copies of User Content solely to operate, secure, and improve the Service you initiate. You represent you have the rights to submit User Content and that it does not violate law or third-party rights.

8. AI Outputs and Responsibility

AI outputs may be inaccurate, incomplete, or inappropriate. You are solely responsible for evaluating and using outputs. Do not treat outputs as professional advice (medical, legal, financial, or other regulated advice). You must review and fact-check outputs before relying on them.

9. Third-Party Integrations and Scopes

If you enable integrations (for example, Google Drive/Docs, YouTube, TikTok Display, Instagram/Meta):

  • You authorize KunkaAI to access provider-permitted data only for the features you enable and the items you select.
  • Access can be revoked in the third-party account and in KunkaAI settings.
  • Your use remains subject to each provider's terms and scopes.
  • Data handling details are in the Privacy Policy and Cookie Policy.

10. EEA Consumer Notice (Digital Services)

If you are a consumer in the EEA, you may have a 14-day right of withdrawal. If you ask to start the Service immediately, you acknowledge the right of withdrawal is lost once delivery begins. Business (B2B) customers do not have this right. This notice supplements the Refund Policy.

11. Data Protection; Privacy; Cookies; DPA

These documents are incorporated by reference.

12. Security and Vulnerability Reports

Report security issues to legal@kunka.ai. Do not publicly disclose until we confirm remediation.

13. Intellectual Property; Feedback

The Service, software, and content (excluding User Content) are owned by KunkaAI or its licensors and are protected by intellectual property laws. You grant KunkaAI a perpetual, worldwide license to use feedback you choose to provide without restriction.

14. Notice-and-Takedown (Copyright/Content Complaints)

Send notices to legal@kunka.ai with:

  • Your contact information.
  • Description of the copyrighted work or right allegedly infringed.
  • URL or precise location of the material.
  • Statement under penalty of perjury of your authority and accuracy.
  • Your signature (physical or electronic).

We may remove content and terminate repeat infringers.

15. Beta/Preview Features

Features labeled alpha, beta, preview, or experimental are provided "as is," may change without notice, and may be subject to additional terms or limits.

16. Termination

  • By you: Cancel any time in account settings or via support@kunka.ai. Access continues until the end of the paid term unless we state otherwise.
  • By us: We may suspend or terminate for cause (including violations, non-payment, or risk to the Service) or for convenience with reasonable notice.
  • We may retain certain records as required by law and as described in the Privacy Policy.

17. Disclaimers

The Service is provided "as is" and "as available." KunkaAI disclaims all warranties to the fullest extent permitted by law, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant uninterrupted or error-free operation or that outputs will meet your requirements.

18. Limitation of Liability

To the fullest extent permitted by law:

  • KunkaAI's total liability for all claims in any 12-month period is limited to the amounts you paid to KunkaAI for the Service in that period (or €50 if none).
  • KunkaAI is not liable for indirect, incidental, special, exemplary, punitive, or consequential damages, or loss of profits, revenues, data, or goodwill.

Mandatory consumer rights remain unaffected.

19. Indemnification

You will indemnify and hold harmless KunkaAI, its affiliates, and personnel from claims, damages, liabilities, costs, and expenses (including reasonable legal fees) arising from your misuse of the Service, your User Content, or your breach of these Terms or applicable law.

20. Export and Sanctions Compliance

You represent you are not located in, under control of, or a national/resident of any embargoed or sanctioned country or listed prohibited party. You agree to comply with applicable export control and sanctions laws.

21. Electronic Communications; Notices

You consent to receive notices electronically. We may provide notices via the Service, email, or by posting to our site. Legal and privacy notices: legal@kunka.ai and privacy@kunka.ai. Support: support@kunka.ai.

22. Changes to Terms

We may update these Terms. Material changes will be posted with a new "Last updated" date and may be notified via the Service or email. Continued use after changes constitutes acceptance.

23. Governing Law and Venue

These Terms are governed by the laws of Estonia, excluding conflict-of-laws rules. Courts in Estonia have exclusive jurisdiction.

24. Assignment; Force Majeure; Miscellaneous

  • You may not assign these Terms without our prior written consent. We may assign to an affiliate or in connection with a merger, acquisition, or sale of assets.
  • We are not liable for delays or failures due to events beyond reasonable control (force majeure).
  • If any provision is unenforceable, the remainder remains in effect. No waiver is implied by delay or failure to enforce.
  • These Terms, together with documents incorporated by reference (Privacy Policy, Cookie Policy, Refund Policy, Data Processing Addendum, Subprocessors list), are the entire agreement and supersede prior understandings.
  • The English version controls for interpretation.
